Volkswagen wins R$2.23bn battle with dealerships over tax credits

A ruling by the São Paulo Court of Justice (TJSP) freed Volkswagen from having to share about R$2.3 billion in tax credits obtained through the so-called “thesis of the century”—the exclusion of the Tax on the Circulation of Goods and Services (ICMS) from the calculation base of social contributions PIS and Cofins, as defined by the Federal Supreme Court. The Brazilian Association of Volkswagen Distributors (Assobrav) intends to appeal the decision.

Brazil grapples with its organised crime problem

In late August, over 1,400 law enforcement officers from several state and federal agencies participated in a series of raids that Brazilian president Lula da Silva called “the largest response from the Brazilian State to organised crime in our history”.

The raids, named Operation Hidden Carbon, involved enforcement activity across eight Brazilian states aimed at dismantling a suspected $8 billion tax evasion and money laundering scheme benefiting the First Capital Command, known locally as Primeiro Comando da Capital (PCC), the largest organised crime gang in the country. The operation revealed “the tip of the iceberg” of the gang’s money laundering schemes, the justice minister said on the day of the August raids.

Anti-Corruption Act turns 11 amid weak enforcement

Law 12846/2013, better known as the Anti-Corruption Act (LAC), was enacted 11 years ago to penalize private companies involved in corrupt practices against public administration, both civilly and administratively. Yet more than a decade later, the LAC remains an underused enforcement tool. Data from the National Register of Sanctioned Companies (CNEP), updated in February, highlight not only the low application rate but also a stark asymmetry in how different branches of government impose sanctions.
